# The proposed artwork–villa exchange and the separate sale

**Question.** Was the proposed artwork-for-villa exchange carried out?

**Answer.** The retained account describes preparation and a signed contract; Benko’s lawyer says the proposed exchange was never executed. A separate Basquiat sale followed.

## The 2021 paintings

- Analysis: The retained investigation account says Benko personally bid for Basquiat’s Self Portrait in March 2021 for EUR 10.53 million and Picasso’s L’Étreinte in June for EUR 17.18 million. The Basquiat invoice reportedly changed from René Benko c/o Signa Holding to Laura Privatstiftung; his correspondence said the bidding was for Laura. Picasso was intended to be billed through Laura AAA Kunst GmbH & Co KG, then being formed. These arrangements are not a court finding that the paintings were personally owned by Benko or misappropriated. [s-d309]
- Attributed: The retained investigation account says Benko personally bid for Basquiat’s Self Portrait in March 2021 for EUR 10.53 million and Picasso’s L’Étreinte in June 2021 for EUR 17.18 million. The Basquiat invoice was reportedly changed from René Benko c/o Signa Holding to Laura Privatstiftung; Benko’s correspondence said he bid for Laura. A 2023 policy named Laura as policyholder, Nathalie and René Benko as additional insureds and Villa N Igls as the location. [s-d309]
  - Qualification: Bidding, invoice routing and insurance are evidence of the reported practical arrangements, not a court finding of personal ownership or misappropriation. Picasso was intended to be billed through Laura AAA Kunst GmbH & Co KG, then being formed.
  - Response: Benko denies criminally relevant participation in the reported artwork/villa transaction.
- Analysis: A 2023 insurance policy reportedly named Laura as policyholder, Nathalie and René Benko as additional insureds, and Villa N Igls as the insured location, covering both paintings for EUR 28 million. Policyholder, additional insured and place of display are different capacities. The EUR 28 million insurance value also differs from the EUR 29.41 million proposed exchange value and the prices at auction. [s-d309]

## Villa shares as proposed consideration

- Analysis: The proposal followed the August 2023 transfer of Villa Eden Gardone from SIGNA Holding towards INGBE. From October, the reported plan was for INGBE to transfer 63% of that villa company to Laura in return for the Picasso and Basquiat paintings valued together at EUR 29.41 million. The foundation council submitted a suspicious-transaction report to Liechtenstein’s SFIU on 7 November 2023, the reported contract-signing date. That report is a suspicion notification, not a money-laundering conviction. [s-d309] [s-d174]
- Attributed: A retained August 2026 investigation account says SIGNA Holding transferred Villa Eden Gardone Beteiligung S.à r.l., owner of six Lake Garda villas, to INGBE in August 2023 for EUR 46.3 million, set off against Signa Prime shares. Investigators considered Prime materially insolvent from 31 March 2022. [s-d309] [s-d174]
  - Qualification: The price and earlier insolvency assessment are allegations in the reported police account, not figures contained in the separate ownership filing or a judgment. The villa company is distinct from the hotel company sold to Lehmann.
  - Response: Benko denies criminally relevant involvement; his lawyer says the later proposed artwork/villa exchange was not executed.
  - Outcome: By May 2026 the Holding estate’s approximately EUR46.4 million Ingbe dispute had ended in a confidential judicial settlement; its terms and merits were not disclosed.
- Attributed: A retained police-report account says INGBE planned in October–November 2023 to transfer 63% of Villa Eden Gardone to Laura Privatstiftung for Picasso and Basquiat artworks valued together at EUR 29.41 million. INGBE’s board filed a suspicious-transaction report on the contract-signing date, 7 November 2023. In January 2024 Laura separately sold the Basquiat to INGBE for EUR 11.08 million, reportedly for anticipated liquidity needs. [s-d309]
  - Qualification: The proposed exchange and the later separate artwork sale were different events. The planned 63% villa transfer is not established as completed; Wess says the exchange was never executed.
  - Response: Benko’s lawyer Norbert Wess says the proposed exchange was never executed and Benko denies participating in a criminally relevant transaction.
- Analysis: Benko’s lawyer Norbert Wess denied criminally relevant participation and said the proposed exchange was never executed. That defense changes the central description: a proposed share transfer must not be presented as completed 63% ownership by Laura. The defense concerns this later plan, rather than a blanket denial that the preceding August villa transfer happened. [s-d309]

## The separate January 2024 event

- Analysis: The same retained account reports that Laura eventually sold only the Basquiat to INGBE for EUR 11.08 million in January 2024, citing anticipated liquidity needs. This is a separate reported purchase, with a different asset and consideration, from the unexecuted two-painting/63% villa-share plan. The record does not supply a final criminal judgment on that artwork transaction. [s-d309]
