SIGNA Holding: ownership, collapse and proceedings

Benko’s personal-insolvency cases: charges and outcomes

The personal-insolvency prosecutions produced distinct outcomes. The gift and rent case and the valuables case must be kept separate from the later guarantee and rifle indictment and the litigation-fraud investigation.

2The gift and advance-rent prosecution

analysisWKStA announced its first Signa-complex indictment on 15 July 2025. It alleged that, as Benko’s personal insolvency approached, a EUR360,000 advance payment of rent and operating costs and a EUR300,000 gift to relatives placed assets beyond creditors’ reach. The alleged EUR660,000 damage and the stated one-to-ten-year statutory range were the prosecution’s case, rather than a conviction or sentence. The proceeding concerned Benko’s insolvency as an entrepreneur, even though it formed part of the wider Signa investigative complex. 1

qualification
The original allegations must be read with the later partial acquittal, appeal and revised outcome rather than described as an unresolved first indictment throughout.

attributedOn 15 July 2025, WKStA announced its first Signa-complex indictment against Benko, alleging that EUR 360,000 advance rent and costs and a EUR 300,000 gift to relatives concealed assets as personal insolvency approached. The alleged damage was EUR 660,000 and the prosecution stated a possible one-to-ten-year sentence. 1

qualification
The original allegations must be read with the later partial acquittal, appeal and revised outcome rather than described as an unresolved first indictment throughout.
outcome
The October 2025 trial initially resulted in conviction on the gift and acquittal on rent; later reporting describes reversal of the acquittal and an aggregate 30-month final sentence.

analysisInnsbruck Regional Court’s first ruling on 15 October 2025 was mixed: it convicted Benko over the EUR300,000 gift and imposed two years of immediate imprisonment, while acquitting him on the EUR360,000 rent count. Both sides challenged the decision. The subsequent account describes Supreme Court reversal of the rent acquittal in July 2026, followed by an aggregate 30-month sentence at Innsbruck in September 2026, reported as final. The original partial acquittal remains part of the history; it must be read with its later reversal, rather than presented as the lasting outcome. 2 3

qualification
The October 2025 ruling was initially nonfinal. The Supreme Court overturned the rent acquittal in July 2026; the later September account reports a final aggregate sentence of 30 months, a distinct stage from confirmation of the original gift conviction.
outcome
The July 2026 reversal of the rent acquittal was followed by a reported final aggregate 30-month sentence in September 2026.

3The valuables case and Nathalie Benko’s acquittal

analysisA separate trial on 10 December 2025 concerned alleged concealment of EUR120,000 cash and eleven expensive watches, watch accessories and cufflinks valued at EUR248,817. René and Nathalie Benko both denied the allegations. Wess said the watches and cufflinks had been gifted to Benko’s sons and occasionally borrowed back, other watches were given to Nathalie for charity auctions, and the cash was Nathalie’s household money and savings. Her lawyer said she bought the safe to protect her own valuable rings during a move; the rings were not part of the charge. The court partly convicted René and imposed 15 months of suspended imprisonment plus a fine of 360 daily units at EUR12, but acquitted Nathalie in doubt. The ruling was not final at that time. The allegations against both defendants therefore cannot be narrated as if both were convicted. 1 2 3

qualification
This reported account establishes the described actors, period and scope, not an independently confirmed later status.
response
The defence said the valuables had been gifted to the sons or for charity auctions, and the cash was Nathalie’s household money and savings; Nathalie’s lawyer said the safe protected her own rings during a move.
outcome
Nathalie was acquitted; René partly convicted and sentenced to 15 months suspended and a fine, then nonfinal. Later conviction confirmation and sentencing status are recorded separately.

attributedAt the 10 December 2025 trial, René and Nathalie Benko denied allegations of concealing EUR 120,000 cash and eleven watches and accessories worth EUR 248,817. The court partly convicted René and acquitted Nathalie in doubt; the 15-month suspended sentence and fine were then not final. 1 2

qualification
This reported account establishes the described actors, period and scope, not an independently confirmed later status.
response
Both defendants denied wrongdoing. The defense said the watches had been given to the sons or Nathalie for charity auctions and sometimes borrowed back, while the cash was Nathalie’s household savings, largely set aside years earlier.
outcome
Nathalie was acquitted; René partly convicted and sentenced to 15 months suspended and a fine, then nonfinal. Later conviction confirmation and sentencing status are recorded separately.

attributedOn 10 December 2025, Innsbruck Regional Court partly convicted René Benko over concealment of valuables and imposed 15 months' suspended imprisonment and a fine of 360 daily units at EUR 12. Nathalie Benko was acquitted in doubt. A later retained account reports Supreme Court confirmation of the conviction in September 2026, with sentencing still for the Innsbruck appellate court. 3 1

qualification
The December 2025 ruling was a partial conviction of René Benko and acquittal of Nathalie, with both denying the allegations. A later account reports confirmation of the conviction in September 2026, while sentencing remained for the Innsbruck appellate court.
response
Both defendants denied wrongdoing. The defense said the watches had been gifts to the sons or to Nathalie for charity auctions and sometimes borrowed back; it described the cash as Nathalie’s household savings, largely set aside years earlier.
outcome
Nathalie Benko was acquitted in doubt. The later account reports René Benko’s conviction confirmed, with sentencing still to be determined by the Innsbruck appellate court.

analysisThe later account distinguishes confirmation of René Benko’s conviction from the remaining sentencing issue before the Innsbruck appellate court. Its chronology is separate from the July 2026 reversal of the acquittal in the advance-rent case. Keeping those two appellate tracks distinct prevents the finality of one decision from being transferred to another. Nathalie’s acquittal must remain visible wherever the valuables allegations are summarized; her unrelated corporate interests do not change that outcome. 3 1 4

qualification
The December 2025 ruling was a partial conviction of René Benko and acquittal of Nathalie, with both denying the allegations. A later account reports confirmation of the conviction in September 2026, while sentencing remained for the Innsbruck appellate court.
response
Both defendants denied the allegations.
outcome
Nathalie Benko was acquitted in doubt. The later account reports René Benko’s conviction confirmed, with sentencing still to be determined by the Innsbruck appellate court.

documentedThe Austrian register identifies Nathalie Benko as NB Immo GmbH's sole shareholder and managing director from 2 December 2017. The Innsbruck property company, FN 481230 t, has EUR 35,000 capital; a December 2023 function deletion does not identify whose function ended, and filings continue through September 2026. 4

qualification
The unnamed function deletion cannot be assigned to Nathalie while the explicit current card still names her; her corporate role does not override her acquittal in the separate valuables case.

4The June 2026 charges and a separate investigation

analysisWKStA’s release of 12 June 2026 announced a further indictment alleging serious fraud through a false repayment guarantee to representatives of an unnamed investor foundation. It alleged that the guarantee induced about EUR3.3 million to be transferred to SIGNA Holding and another EUR1.7 million in recovery to be forgone. The promised EUR5 million repayment by 30 June 2024 did not occur, according to the prosecution, which alleged unlawful enrichment of the Holding and another company. A separate reported account identifies Hans Peter Haselsteiner as the investor behind the allegation, while the official release leaves the legal foundation unnamed. 1 2 3 4 5

qualification
The official prosecutor did not name the investor foundation. A report identifies Haselsteiner, but this does not make Haselsteiner personally the exact legal payor.
response
The wider de facto-control theory is disputed by Benko and his lawyer; the official indictment remains an allegation.
outcome
This indictment was filed in June 2026; no outcome on these particular counts is established in the retained record at the 10 October 2026 cutoff.

attributedOn 12 June 2026, WKStA announced a further Innsbruck indictment against René Benko alleging serious fraud through an untrue repayment guarantee to an investor foundation and fraudulent insolvency through concealment of an EUR 80,000 hunting rifle. The prosecution stated a possible sentence of one to ten years. 1 2

qualification
The June 2026 indictment and maximum statutory penalty are prosecution allegations, not a sentence or conviction on those counts. The investor foundation is unnamed in the release.
outcome
This indictment was filed in June 2026; no outcome on these particular counts is established in the retained records at the 10 October 2026 cutoff.

attributedWKStA alleged that Benko's untrue guarantee induced an unnamed private foundation to transfer about EUR 3.3 million to SIGNA Holding and forgo recovery of another EUR 1.7 million, promising EUR 5 million repayment by 30 June 2024 that did not occur. The prosecution alleged unlawful enrichment of the Holding and another company. 1 3

qualification
The official prosecutor did not name the investor foundation. A report identifies Haselsteiner, but this does not make Haselsteiner personally the exact legal payor.
outcome
No repayment occurred by the promised June 2024 date according to the prosecution; no final criminal judgment on this count is established here.

attributedReporting identifies Hans Peter Haselsteiner as the investor behind the EUR 5 million guarantee allegation, states that Benko signed the guarantee in early November 2023 and that the investment was not repaid after Signa collapsed. Separate investigation continued into the summer 2023 capital increase. 4 5 1

qualification
Investor identity is supplied by reporting of the indictment; the official release refers to an unnamed foundation and distinguishes EUR 3.3 million transferred from EUR 1.7 million forgone recovery.
response
The wider de facto-control theory is disputed by Benko and his lawyer; the official indictment remains an allegation.

analysisThe same indictment also alleged that Benko concealed an EUR80,000 hunting rifle during the Holding’s insolvency and his own insolvency as an entrepreneur. Its stated one-to-ten-year range describes the available penalty if convicted, not a sentence already imposed. The release also announced a different investigative strand concerning an alleged attempt to mislead a civil court over a January 2023 EUR2 million payment to a relative. The suspicion was that the payment was falsely described as maintenance rather than a gift, supported by an inaccurate memorandum, with Benko contributing through alleged false testimony. That continuing investigation is distinct from the filed guarantee and rifle indictment. 1 2

qualification
This is an announced suspicion and continuing investigation, not an established falsehood or a completed criminal trial.
outcome
The investigation remained an announced suspicion in the June 2026 release.

5The wider investigative context

analysisThe number and reported damage of investigations changed over time. WKStA’s July 2025 statement described more than a dozen suspects and two corporate defendants, with EUR300 million then under investigation. Those dated figures are not final losses or conviction counts for the whole case. In Italy, Trento prosecutors sought trial of 37 people, including Benko and Heinz Peter Hager, on allegations of an association to secure contracts and building approvals improperly. A preliminary hearing was scheduled for 23 October 2026, after the evidence cutoff. Separate Munich and Liechtenstein investigations also appear in the accounts, and must not be treated as convictions from the Austrian personal-insolvency trials. 1 2 3

qualification
The Trento trial request and accusations are not convictions. The 23 October hearing was still prospective at the 10 October 2026 evidence cutoff; Munich and Liechtenstein investigations are separate proceedings.

attributedIn July 2025 WKStA said it had investigated the Signa complex since late 2023 with SOKO Signa, concerning serious fraud, fraudulent insolvency, breach of trust, subsidy misuse and creditor preference, with more than a dozen suspects and two corporate defendants. It then estimated investigated damage at EUR 300 million; this was a dated investigatory figure. 1

qualification
The EUR 300 million estimate and suspect count are dated July 2025 investigation scope, not a casewide final loss or conviction count.
